Whistler Singletrack's Terms of Service

In order to take part in a Whistler Singletracks activity, participants must agree to the following terms of service. If participants do not comply with the requirements described in this page, Whistler Singletracks reserves the right to cancel the lesson/tour or restrict participation.

 MANDATORY PAPERWORK

Every guest must have the following documentation filled out and signed before the beginning of any activity. The easiest way to do it is right after online registration, there will be a button to the mandatory waiver and online form. If participants/guardians fail to  Parents and guardians must complete and sign paperwork on behalf of anyone under 18 years of age.

1. Liability Waiver signed, confirming that it has been read, understood and agreed with.

2. Online form. Is attached to the Liability waiver; includes medical information, rider info and emergency contacts. If this form is not filled accurately it will have a negative impact on your safety and the experience of the rest of participants. We reserve the right to change a ride plan or deny a rider participation in an activity if the information provided is not accurate.  

MANDATORY GEAR

Guests must come with the following gear to an activity.

1. BIKE

– Must have safe and well functioning brakes.

– Must be in good working order, no broken parts.

– Must fit the rider properly.

– No loose parts like axles, spokes, saddles, headset, etc…

– Drivetrain in good working condition.

– Tires with sufficient thread and air pressure.

 

2. HELMET

– Must be a bike helmet.

– Must fit properly on the head with almost no wiggle.

– Must have an adjustable strap under the chin and adjustment on the back of the helmet to tighten or loosen around the head.

– Ensure that there the chin strap does not go over the chin.

 

3. ADDITIONAL GEAR

– Appropriate attire for riding (comfortable, athletic, weather dependent).

– Closed-toed sport shoes.

– Knee pads are mandatory, gloves are highly recommended, elbow pads recommended.

– Tube that fits bike.

– Sunscreen depending on the weather.

– Water and food (Riders need to bring their own water and food, amount depends on the length of the activity).

– Backpack or hip bag depending on the length of the activity.

WEATHER POLICY

We ride in all weather conditions, rain or shine; is part of mountain biking. Unless the weather deems unsafe to ride. Sometimes activities will be canceled or shortened when weather is not friendly:

  • With heavy rain +1mm/hr, activities will have maximum 2.5 hour length.
  • When air quality Index is 9 or higher activities will be cancelled. Air quality 7-8 activities will have a 2.5 hour length.
  • At temperatures below 6 degrees celsius rides will be cut to 2.5 hours, specially with kids.
  • We will not ride at temperatures 35+ degrees celsius. Usually activities start time will shift to early mornings or evenings.
  • We will not ride while thunderstorms in the area. They tend to happen in the afternoon for 1-2 hours, we might have to shift ride times to avoid them.

If we have to cancel activities fully or partially because of these reasons guests will receive a refund proportional to unused time, $15 administrative fee applies.  

SAFETY RULES 

Participants of any mountain biking activity must adhere to the safety rules. We reserve the right to reschedule a ride or deny a rider participation if not conveying with these rules.

  1. Participants are not permitted to pass others in the group and must maintain a distance of at least 6 seconds between riders.
  2. Every rider must stay in control at all times, ride at your own pace and be always ready to stop.
  3. Stop where you are visible and move to the side of the trail.
  4. Everyone should refrain from eating or touching plants, berries, mushrooms or disturbing vegetation.
  5. Don’t approach, disturb or provoke wildlife. Respect nature and don’t litter. 
  6. If an encounter with a big animal occurs, stay with the group. Don’t run away. Only approach dogs if owners allow. 
  7. Look both ways before entering/starting a trail and yield to other users.
  8. If separated from the group stay where you are. Stay by your bike on the trail, blow a whistle if necessary. Do not go off trail.
  9. Never ride a bike if your ability is impaired through the use of drugs or alcohol.
  10. You must have sufficient physical dexterity, ability, and knowledge to safely ride a mountain bike trail.
  11. Riders must be respectful with all other group members and people in general as well as the environment.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to refund or reschedule only according to our Cancelation Policy.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

 

SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

 

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In no case shall Whistler Singletracks, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. in particular, you agree to indemnify and hold harmless Whistler Singletracks, its officers, employees and sponsors for any injury, including but not limited to bodily harm or death, to you or any third party that may result from the use of or reliance on any content in this website. We recommend that users exercise their own skill and care with respect to the use of any content and should obtain any expert advise they consider necessary. In no event shall Whistler Singletracks be liable for any direct, indirect, incidental, special, or consequential damages that result from or in connection with the use of, or the inability to use, the website or any content or services

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of WHISTLER, BC, Canada.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

 

SECTION 20 – CONTACT INFORMATION

COVID-19 POLICY (Not active)

Lessons and rides will be cancelled if participants or coaches;

– Have or had symptoms of COVID-19 in the last 14 days: fever, chills, new cough, shortness of breath, sore throat and new muscle aches or headaches.

– Have been directed by Public Health to self-isolate.

– Have arrived from outside of Canada or had contact with a confirmed COVID-19 case in the last 14 days.

– If a lesson is cancelled for COVID-19 reasons we will reschedule or refund, check our Cancellation policy.

 

Measures in place:

– Our operations are 100% outside.

– Before the start of the activity coaches and guests are asked to do a self health screening and call +1 (604) 967-3309  if are not feeling healthy.

– Guests and coaches are asked to cough or sneeze into your elbow.

– Guests and coaches are asked to carry hand sanitizer and a mask. You don’t need it on when riding, only in case we need to brake the 2 meter distance.

– All staff have been shown the correct use of masks and other PPE. Masks are used in first aid scenarios when physical distancing cannot be maintained.

– Please note that we will be practicing physical distancing throughout the lesson and we ask everyone stays 2 meters (6ft) apart at all times. 

– If we have to come within 2 meters (6ft) of you (or your child) we will both use masks.

– Participants are asked to ride 6 seconds from each other when riding.
